VTECH $1,000,000 Baseball Giveaway

1. The VTech $1,000,000 Baseball Giveaway (the “Contest”) will commence March 31, 2008 and will operate until September 28, 2008 (the “Contest Period”) in all Canadian Provinces excluding Quebec. The Contest is open to residents of the above provinces who are over the age of majority according to the laws of the province in which they reside, subject to the exceptions set out in Rule 6.

2. From 9:00 am on March 27, 2008 until 3:00 pm on September 26, 2008, contestants can enter the Contest online at www.vtechbaseballgiveaway.com by providing full name, address, telephone number and/or e-mail address. Limit one entry per person per day. Participants can receive additional chances to win by using the ‘refer a friend’ feature on the website as follows: one additional chance is received for each valid friend’s e-mail address provided. To be eligible for additional chances participants must first confirm that he/she has the authority to provide the e-mail address for each friend referred. Contestants can also enter by legibly printing their name, address and telephone number on a plain piece of paper and mailing to:

Limit of one entry per envelope. Entries must be received no later than September 26, 2008.

3. A prize will be awarded for every home run scored by the Toronto Blue Jays throughout the regular Major League Baseball season during the Contest Period. The Prizes available to be won are as follows:

VTech i6787 5.8 GHz. Digital Spread Spectrum four handset telephone system APPROXIMATE VALUE - $189.99 or
VTech LS5145 5.8 GHz. Digital Spread Spectrum with Bluetooth wireless technology APPROXIMATE VALUE - $189.99

Prizes must be accepted as awarded with no substitutions (cash or otherwise). Maximum of one prize per winner. Odds of winning any prize depend upon the number of valid entries received and the number of Toronto Blue Jays’ home runs scored during relevant games as outlined above.

4. In addition to the prizes outlined in Rule 3, should a Toronto Blue Jays’ player hit for the cycle (single, double, triple and home run) during the regular Major League Baseball season as recorded by Major League Baseball, one (1) contestant, through a random draw of all entries received, will qualify to win an annuity paying $50,000 per year for 20 years.

Please note the special conditions of the $1,000,000 annuity prize:
Entry is drawn prior to each regular season Toronto Blue Jays’ game during the Contest Period. There can only be one (1) $1,000,000 winner during the contest period. If Promotivate LP (hereafter “Promotivate”), acting reasonably, cannot contact the winner within ten (10) days of the Blue Jays’ cycle being completed, Promotivate reserves the right to contact the next entrant chosen.

The $1,000,000 annuity prize will be awarded in 20 equal installments of $50,000 payable annually. The payout is governed by Revenue Canada’s rules for Prescribed Annuities.

Payment of any and all taxes, or other charges associated with the $1,000,000 annuity prize are the sole responsibility of the prize winner.

5. Qualifying winners will be judged and prizes (including $1,000,000 annuity prize if applicable) awarded based on correctly answering, unaided, a time limited, mathematical skill-testing question and properly completing an official contest Affidavit & Release. Every eligible winner will receive his/her prize within eight weeks of verification. The $1,000,000 annuity prize will be awarded in accordance with Rule 4.

6. Employees of VTech Electronics Canada Ltd. (“VTech”), Promotivate, Rogers Sportsnet (RSN), The Fan 590, advertising agencies and promotional companies involved in the Contest, as well as family members of same residing in the same household shall be ineligible to participate in the Contest.

7. No correspondence will be entered into with contestants (other than winners and potential winners) unless contestant grants permission. Promotivate is the sole judge of the Contest and its decision about any aspect of this contest shall be final and binding. Promotivate and VTech reserve the right to use the winners’ names and/or photographs in any advertising or publicity, with no compensation to the winners. All potential winners’ names will be broadcast on The Fan 590 Radio and/or RSN during game broadcasts throughout the Contest Period. Winners’ names may further be revealed to the public in accordance with Rule 11.

8. Promotivate and VTech may cancel or substitute any prize for equal or greater value for the duration of the Contest.

9. Promotivate, VTech, The Fan 590, RSN and any of their respective affiliates, agents, officers, directors and employees will not be responsible for any adjustments in scheduling of Toronto Blue Jays’ broadcasts which may force the contest to cease operations either temporarily or permanently. Promotivate and VTech reserve the right to terminate or modify the Contest at any time without prior notification. None of Promotivate, VTech, The Fan 590, RSN and other releasees shall be responsible in any way for the use of or bear any liability whatsoever in any way attributable to the prizes awarded in this contest.

10. None of Promotivate, VTech, The Fan 590, RSN and other releasees will be responsible for any electronic network, computer problem or any other technical error or malfunction of any kind that may affect contest operations, nor shall they be responsible for any problems that may arise, including but not limited to technical malfunctions of telephone network or lines, computer online systems, servers or providers, computer equipment, software, viruses, bugs or failure of any e-mail to be received for any reason including but not limited to traffic congestion on the internet or any website or combination thereof. Promotivate, The Fan 590, RSN and other releasees are not responsible for damage to a user’s system occasioned by participation in this Contest. Not responsible for lost or misdirected entries.

11. Entry into this contest constitutes acceptance of these rules. Winners’ names may be posted on the Contest website during and at the conclusion of the Contest Period.
